A Hempstead man who claimed he had suffered a work-related injury to his foot in 2007 has been charged two years later with fraudulent practices in violation of the New York State Workers’ Compensation Law.
Since June, 2007, Robin Ardiano, 30, of Hempstead, New York, has been receiving $175 per week in workers’ compensation benefits from the New York State Insurance Fund.
In April of this year, Ardiano was found allegedly doing maintenance work for an apartment complex in Nassau County. An investigation by NYSIF determined he had been employed by the apartment complex since August, 2008.
During that period, Mr. Ardiano had submitted several forms to NYSIF indicating he was not working. Additionally, on November 6, 2008, he testified at the Workers’ Compensation Board in Hempstead that he was not employed.
As a result, Ardiano was charged with defrauding NYSIF of $7,175. The amount of savings over the life of the claim is estimated at approximately $36,000.
