Western New York Man Indicted For Workers’ Comp Fraud

An investigation initiated by the New York State Insurance Fund’s Division of Confidential Investigations revealed that 58-year-old Robert Stanton of the Livingston County community of Avon signed statements attesting to NYSIF that he had not returned to any form of work while he was employed buying and selling cars for auto dealerships.

Mr. Stanton had been receiving workers’ compensation benefits from NYSIF since he was injured in a 1993 work-related accident while employed at a country club in Spencerport, New York.

The NYSIF investigation determined that Mr. Stanton was employed in the purchase and sale of cars as an agent for automobile dealers in 2007 and 2008 while receiving wage replacement benefits to which he was not entitled.    

The charges against Mr. Stanton allege that during that period he committed fraud against NYSIF totaling nearly $9,000. Potential future savings in this case are estimated at $227,883.

Mr. Stanton was arrested on charges of grand larceny, insurance fraud, workers compensation fraud and offering a false instrument for filing. He was indicted by a Livingston County grand jury and is now free on $1,000 bail awaiting further court action November 5. According to District Attorney Thomas Moran, Mr. Stanton faces a maximum of seven years in prison if convicted on all charges in the indictment.

Indictments and criminal complaints are accusations only. Defendants are presumed innocent until proven guilty.
