Code Rule 59 Penalties

What if I refuse to undergo the CR 59 process, or don’t comply with the consultant’s recommendations?

If you have not complied, all workers’ compensation carriers are required by Code Rule 59 statute to impose a 5% penalty on your worker’s compensation renewal premium.  The penalty increases by an additional 5% each year you fail to comply. That penalty continues to apply until you comply, even if you change insurance companies.
