Claimant Benefits

Workers' compensation insurance protects employers from liability for on-the-job injuries resulting in employee disability or death, providing injured workers with compensation benefits and medical benefits, or, in the case of death, survivor benefits to their dependents.

Medical Benefits may include hospitalization, doctor services, dentist services, physical therapy, chiropractic treatment, x-rays, laboratory tests, nursing service, durable medical goods and prescribed drugs (Prescription Benefits) (Express Scripts Pharmacy Locator).

Compensation Benefits are subject to current statutory maximums of $550 per week. An injured worker may collect compensation benefits to replace lost wages due to job-related disablement. Compensation benefits are not paid for the first seven calendar days of the job-related disability, unless the disability extends beyond 14 calendar days. Learn more about compensation benefits.

Death and Survivor Benefits are paid if an injured worker dies from a job-related injury. The surviving spouse and/or minor children and, lacking such, other dependents as defined by law are entitled to death and survivor benefits. The amount is equal to two-thirds of the deceased worker's average weekly wage for the year before the accident, subject to statutory maximums, currently $550. Death benefits are shared by all surviving dependants. Funeral expenses are payable up to the statutory maximum, currently $6,000 in metropolitan New York counties and up to $5,000 in all other New York counties.
