New Class Code for Telecommuters

As a reminder, NYSIF wants to hear from you to determine if we need to adjust your payroll to reflect changes that could lower your premium. For example, if your employees have been reassigned due to the coronavirus (COVID-19) pandemic, they may be eligible for a new workers' compensation classification code, 8873 – Telecommuter Reassigned Employees, created by the New York Compensation Insurance Rating Board (NYCIRB) and approved by New York State Department of Financial Services.

The new class code applies to eligible payrolls affected by COVID-19, effective May 1, 2020 for new or renewal policies, and for all policies in force from March 16, 2020 through April 30, 2020.

The code will be applied only to the payroll of employees who, during New York’s COVID-19 stay-at-home (and future stay-at-home orders), are reassigned to either not perform any work duties (idle) or perform clerical work duties at home.

Code 8873 does not apply to employees who are already classified in code 8871 – Telecommuter Clerical Employees, code 8810 – Clerical, or code 8809 – Executive Officers.

In addition, the new code does not apply to nonpayroll operations, such as volunteer firefighters’ benefits law or volunteer ambulance benefits law policies, building operations code 9027, or domestic service codes 0908, 0909, 0912, and 0913.
