Premium Credit Program for Eligible NYSIF Healthcare Policyholders - Safe Patient Handling
Beginning October 1, 2017, NYSIF policyholders in eligible healthcare payroll classifications may be qualified for a flat 2.5% premium credit. To receive the premium credit, policies in force on October 1, 2017, or thereafter, must be in compliance with the provisions of the New York Safe Patient Handling Act (NYSPHA), codified in Article 29-D, Title 1-A of the New York State Public Health Law. Classifications that may be eligible to receive a premium credit include, but are not limited to, the following:

8829 - Nursing Home-All Employees
8833 - Hospital-Professional Employees
8865 - Alcohol or Drug Rehabilitation Facility-All Employees & Clerical
8866 - Assisted Living Facility-All Employees & Clerical
9040 - Hospital-All Other Employee
8854 - Health Care Services Professional-Traveling
9101 - College Schools-All Other Employees
8864 - Developmental Organizations-All Employees, Sales and Drivers

Mandatory NYSPHA compliance must be verified by a NYSIF Risk Control consultant in accordance with New York State Insurance Regulation 119, 11 NYCRR 151-7.2(b). NYSPHA program compliance must be verified each year the healthcare facility program is in place to remain eligible for the premium credit. In addition, the following guidelines must be met to be considered for a NYSPHA credit:
  • NYSIF policyholders seeking the NYSPHA credit for the first time must have an established NYSPHA program, maintained for at least 180 days prior to the policy renewal date. 
  • Policyholders seeking the NYSPHA credit for the first time must contact NYSIF to arrange for a compliance visit at least 90 days before the policy renewal date. 
  • Policyholders seeking the NYSPHA credit for the subsequent year must substantiate that they have conducted on an annual basis, all of the following: NYSPHA required training, performance evaluation of the NYSPHA program, and evaluation of the number of employee patient-handling claims. 
  • The initial compliance visit and subsequent year compliance reviews must be completed at least 60 days prior to the policy renewal date.
